Nearly 11 years after injury mailing in a letter with doctors notes of my disability Ballys did not cancel my contract and wants to come after my SSI over an unpaid balance. After my request!!! This is a scam of the worst type. Bordering on senior abuse.

I purchased a lifetime membership to Ballys in the mid 1980s when it was Jack LaLanne. I used the club on 86th street in Brooklyn and on 32nd Street in Manhattan. When Ballys switched over to 24 Hr Fitness, my membership was sold to TapOut Fitness. When I tried to cancel the membership, they told me I had automatic renewals on and that I could not cancel. I’ve tried calling and emailing, but no one responds. How could they be so deceptive? If there is a class action suit against Ballys or 24 hr fitness then please count me in.

Hi Gloria I am interested in a class action suit as 24 Hr Fitness will not let bally members use their clubs and they only bought 30 clubs and I got left out of tbe better club LA Fitness which bought 230 of the Ballys clubs,. My club is dirty has low life people and bug infestation and I want to be in LA Fitness but the will not let me now

I joined President and First Lady in 1985. Life time membership in Houston, TX. During the years membership was sold to Bally’s then to Blast. Same gym, one mile from home. In 2014 I was told by a Blast employee my membership was sold to Gold’s’ which is 35 miles from home. After numerous phone calls Blast corporate told me my contract with Ballys was assigned to a Ballys gym about 30 miles from home, close to the now Gold’s gym I was assigned. Never been there, clerical mistake obviously. That’s why my membership was sold to Gold’s rather than Blast. Can’t reach anyone at Ballys to fix this problem. I’ll try some of the suggestions I’ve read above.

I’ve skimmed the blog posts and the story seems to be the same. Bally’s was acquired but unclear who actually purchased the clubs. I renewed my membership with Bally’s / LA Fitness and was given a new member number. However, LA Fitness has not record of the member number I was given. Additionally, the payment confirmation number seems to be of no use in tracking my payment or membership.

Bally’s is owned by 24 Hour Fitness. If you use wikipedia, you will find that there are numerous complaints filed with Consumer Affairs and that they are currently under investigation. It’s possible a class action suit is going to be filed.

Today Ballys charged my checking account for my nieces membership which was cancelled. They were told not to renew the membership and they did. I called the bank and told them not to pay anything bally’s tries to process though my checking account. I had cancelled my membership 2 years ago and was glad I did. Never Ballys ever again. The corporate office is always unreachable.

Yesterday I was talked into taking a tour around the Bally Total Fitness gym in Crossgates Mall in Albany, NY. Despite me being extremely hesitant about even considering a membership I eventually agreed to sign up for a potential membership. This was primarily because I felt cornered by the staff, who were constantly saying “when will you come in? You can have your first session now if you would like.” (although I was clearly wearing boots that had 3/4 inch heals on them and jeans), and the only way out I could think of was to agree to possibly sign up for a membership. Once I got home and thought about it I decided it was not the best idea and proceeded to call them today to verbally cancel everything before they received my cancellation notice in the mail. I just spent about THREE hours trying to get a hold of someone within the gym. Absolutely no one answered until just now. Needless to say my impression of this gym is that it is an extremely unprofessional place. It is no wonder the gym was empty when I was being shown around.

A woman opened up and account under my name in the early 90’s she actually stole my identity and obtained a license with all my information and her picture on it. I recently received a letter from New Century Financial Services and they are giving me the run around. I joined President’s First Lady fitness in early 80’s. I purchased a lifetime Heritage membership for $1500.00 with yearly dues of $25.00 per year. ( My membership card reflects this price) This membership included all President clubs throughout the world. It also included special morning hours for Heritage members, an olympic size pool, indoor jogging track, dry sauna, wet sauna, heated whirlpool, showers, aerobic classes, racquet ball courts, numerous training equipment, and personal trainers who assisted you.
I received a letter two years ago stating the Bally’s was closing and my membership was being transferred to Blast clubs. When I checked into this, there is not a Blast club close to my home. The one closest to my home does not offer the benefits I paid for.
I recently read that more Bally’s clubs had closed and the memberships had been transferred to 24 Hour Fitness and LA Fitness clubs. These clubs offer benefits similar to what I paid for with my Heritage membership, and they are closer to my home.
I called to request my membership be transferred to one of these clubs. I have called and left several messages on the listed corporate phone number and have not received a response. I need to know how to contact this company and have my membership transferred to a club with benefits similar to what I paid for.
I am very disappointed in the way Bally’s has handled my membership and I am sure many others.

Received imformation from the USPS that the letter could not be delivered because the addressee (bally) moved and left no forwarding address. The letter was to cancel a membership and to forbid Bally from charging my Credit Card monthly. This is disgraceful. I will contact my credit card company with this information.

i was going to the bally in Riverdale,I purchase 6 months sessions with a personal trainer( we are talking about a little more than $2000) the gym in january change to 24 hour’s fitness, I never got an email or anything telling me about the changes. when i got the session i didn’t get to use them right away, at the same time they told me the that was not an issue and the i can start whenever I want to. Went i want them to use and start my training, in 24 hour’s they didn’t get responsible for my session because they’re not bally anymore. So now what???? If i call the 800 number no one answer! Who’s going to help me here! Do I havet to get to the point that i need to get a lawyer and make this bigger. I want either my money back or my 6 months.

I spoke with a Bally representative after our ONLY Rochester NY Bally’s Club closed. I had purchased a Lifetime membership and was told it would be transferred to a local LA Fitness Club. On March 16, 2015 I spoke with another representative who was going to research my situation. She gave me a confirmation number for the call and was going to contact me with resolution. As of today I have heard nothing. I tried to contact Bally’s again but in vain. I cannot reach a live person via telephone! Also two of their 800 numbers have been disconnected. I’m in the same situation you are. From what I’ve heard LA Fitness did not buy any Bally’s clubs in NY. 24 Hr Fitness purchased the remaining clubs except for the Rochester clubs. I have been trying to get someone to tell me why our club wasn’t included. I have had no luck. Please let me know if you find out anything and I will do the same.

This company is a complete disgrace. I purchased my membership at 2100 Barrow ave Bronx NY. My home gym was bought out by 24hr fitness. I purchased several personal training packages my last package consisted of 72 sessions from which I still had 29 session left they told us that 24hour fitness would honor our membership as well as our training packages. However that was not my case . 24 hour fitness tells me that my account was not purchased because I purchased my membership in a gym in Manhattan which was never the case. I reached out to customer service spoke, to “manager” , email member services sent them proofs of where and when I purchased the membership till this day they have solved the problem. I requested to get a full refund of my entire package because of the unnecessary stress aggravation breach of contract and fraud. Member services told me that it would take 10 business days once the 10 business days expired which happened to be Monday they had the audacity to tell me they couldn’t find my account. I’ve requested the number to their corporate office or a call back from a corporate manager no calls have been made. I already have a lawyer and I’m about to start a lawsuit against Bally’s. I’m so disgusted on how this situation was handled.

Add me to your class action suite. I have been a member of Bally’s since 1996. Despite not using the gym as much as I would have liked, due to physical health reasons, I continued to renew my membership and would get there whenever I could. If I used the gym 3 months out of the year that was a lot. Now the location I used to go (Douglaston) is this 24 hour gym. When I went there they denied me access and said I wasn’t on their transfer list. My membership is paid up until 2017. I can’t get a live person to speak to on 1800 number and 24 hour won’t honor my Bally’s membership. I also never received notification from either gyms about this transfer of ownership. Bally’s has breach their contactual agreement with it’s members. Makes me never want to to sign up for a membership with any other sites ever again. Do only pay as you go, or class by class. I think if I look deep and hard, I will find me original contract agreement from 1996.

I have been calling all of their numbers to find out how to pay my dues. I have been told that my membership number does not exist in their system. I am in the same pot as you. I joined a lifetime membership in 1987. LA Fitness took over a year ago and have yet to received a letter of the transfer. When I tried to use the Springfield Mall new LA fitness, they said I cannot and also they said that it was deactivated. I have been good on all my years of payment. They don’t want me I feel because it is a lifetime membership and most likely they never sent me any information when Bally transferred to them.

I joined Bally (then Jack LaLanne) in 1990 solely to have a place to swim. Over the years, all the Bally’s I’ve gone to have either gone “dry club” (no pool) or closed and became LA Fitness clubs.
My bill for my annual fee usually comes about 6 months before it’s due – and I usually pay it early. I sent a check for my 2015 renewal 7/29/14, and it has been cashed. Yesterday, I went to the last Bally club near me (Englewood NJ) to go for a swim and found it closed with a sign in the window saying it would soon be an LA Fitness club.
I called Bally’s 1-866-402-2559 number 9/16/14 1:30PM to cancel the membership and get the 2015 fee I just paid refunded. The manager of the call center said his name was “Bob Smith”, and he refused to be accomodating or helpful in any way. He also refused to give the name or contact info of anyone higher than himself in the company.
I’ve prepaid a membership renewal for the coming year with no club to go to. This is not acceptable.
The 773-380-3000 number on this page only gives You acces to voicemail (no one answers) – I’d like to know how Messrs. Sheehan, Fanelli, & Wildman can actually be contacted to resolve this without involving litigation.

A similar situation happened to me. I paid $208 in September and Twenty-Four Hour Fitness acquired Bally in December and they refuse to give me a refund. Attempts to speak to their headquarters is unsuccessful. I’m mailing my request for a pro-rated refund. It is unfair for them to charge a membership fee and members cannot attend. I will be reporting to Better Business Bureau and/or litigate if I do not receive a response from them. Thanks for your comments.

I have been trying to contact my Bally’s location for a refund of personal training fees. I was to be billed 5 times 24 sessions beginning January 28, 2014, as stated in the contract. Bally’s billed me in June and again in July for services which ended in May. In fact, I would be refunded for May PT as well, as my personal trainer cancelled my appointment, and never returned my call to reschedule. I am at the gym at 5 am, when none of the management staff is at the club. I have sent two emails to the club directly, with no reply and tried to manuever the phone system with no success in speaking to a person. I will be going there this afternoon to try to speak to someone directly about this!!

In November 1994 I purchased a lifetime premier membership in Bloomfield Hills, Michigan. I attended the gym regularly until 2007-08 because of a back injury. The club continued to mail annual membership fee deals offering lower annual fees, approximatedly at 89.00-99.00/year. My back problem resulted in surgery in December 2011. I have medical doXXXXentation that confirms the length, extent and treatment for my back problems during that time period. During that same time period, Bally’s filed bankruptcy, and then afterward negotiated with LA Fitness to buy its Michigan clubs. Recently I took my LIFETIME premier picture ID to LA Fitness. They said my information was not transferred with other accts. Bally’s member services state they cancelled my LIFETIME membership due to inactivity?! I’ve spoken to several Bally’s reps. One said it was cancellled in 2008 and the other said it was cancelled in Dec 2011…the same month of my surgery. There was no communication from Bally’s that their intent was to ‘cancel’ the LIFETIME membership. I will be providing doXXXXentation of the health issues via certified, insured, signature required mail. The intent is that Bally’s will recognize their breach of contract with me and send my contract information to LA Fitness.

I have been a member of Ballys for over 6 yrs. I signed my 15yr old son 3 months ago. My husband, my son and I sat with your rep for more than 1hr; he went over what I thought was the full contract, my mistakes for trusting Bally’s again. The rep suggested a personal trainer for my 15 yr old son, he pushed and pushed and we agreed on 3 months sessions with a trainer, which was paid in full plus a 3 month free if he’s there 3 times a week. I joined as a member in July 2013 in Albany NY. I was told that there was no yearly contract when I signed up. I just recently signed up for a trainer in February 2014. At the time I signed up I made sure I asked the trainer if I could cancel at anytime. He informed me that I could without a penalty. At the time I joined I was working full-time. Now that I am only working part-time I can’t afford a trainer. I’ve called the club multiple times to try and speak with the Manager Anthony but he is either never there or always busy. I’ve left messages for him to call me back and nothing. I’m very dissatisfied with the management there no one wants to help you or deal with you but they can sure sucker you into joining by hounding you. This is the dirtiest and most unprofessional gym that I’ve ever been a part-of. I’m also a member at Best Fitness in Albany. At Bally’s the equipment is always broken and never repaired. The women’s locker room is always disgusting not to mention there is never any toilet paper or paper towels in the stalls. The spray bottles that you clean the machines off are filled with water as opposed to disinfectant spray. I’m very unhappy with my experience and still I can’t afford to pay for a trainer. Will someone please contact me in regards to cancelling my membership and trainer. Thank you for your time.

We( family of 3) Join Bally fitness on 245st and Horace Harding Expressway . A month later one member dropped out. The other two changed the status of our membership from full access to access for 2 days a week. The sales person who sold us the original membership was a very good sales person. told us all the benefits, gave us price quotes, how it would be paid. He gave us our contracts to sign keeping us distracted from reading the contract . told us ” It’s easy to cancel , just go on line” Little did we know YOU CANNOT CANCEL ON LINE. when you call customer service to cancel there is a FEE to cancel by phone. To ammend your membership, there is a FEE, when I asked about getting a new contract since we changed the status I was told there is a $20 FEE.
I was just charged 29.99 annual membership FEE which I was not informed about when we join. I was told this was to keep membership ACTIVE. Why am I charge to keep my membership active when I am charged membership fees already . . The Gyms job is to reel you in and when you have problems you have to call customer service which is no help at all. It seems the sales person leave out a lot of important info and leave you to fend for yourself after. I enrolled hoping to tone up and get back into working out after a two year break but unfortunately my experience was not what I thought. I enrolled March 10th and was also introduced to the training program that included 4 sessions/$160. A month has passed and I’ve only had three sessions. The training has been inconsistent because my trainer (Jackie) has failed to show up on various occasions. I showed up for my second session and was informed by Michael that she was out ill. No call or text to inform me before I showed up. On my third visit to the gym (March 24th) I showed up at 5:30pm and she never showed up or called. The trainer Ted and Fitness Manager Michael who signed me up also failed to inform me that the personal training would be a recurring payment and that I would have to cancel two weeks ahead. I was also told I would have a better experience here than at 24 hour and am sad to say that has not been the case. I don’t like to complain about things but this is very unprofessional especially when I’m paying a lot of money to get services. Hope you get with your training team to bring this issue to their attention and so that they don’t lose any more clients. Lastly, thanks for your time and would like to hear from you soon about my refund.

Your gym does not maintain high standards of cleanliness and hygiene.
I suggest to put signs clearly state your policies and create a CLEAN, Safe environment for everyone.
Members should show respect for other members’ who will be using the locker and dressing room.
When I come in your gym smells like sweat so extreme need of ventilation is needed to avoid virulent bacteria to spread or maybe open the doors so fresh air would come in and circulate.
You need to add more sanitizer. There are a lot of times there are no paper towels

My name is Ryon Bennett and a couple months ago, in October, I signed up for a membership at your gym stationed in Syracuse New York. After my free trial was up I went through the process of canceling my membership. Another month passed and I viewed my credit card statement and it stated that I had been charged. After calling several times and being either put on hold for long periods of time, or getting no response, I visited the facility again to talk. It was at this point where their salesman, who signed me up originally and taken down all my information, stated they had no record of me being there, but said they would call when they figured it out. I never received a call. I then returned a week later and spoke to the manager who looked in the records and said that my contract was void. Now I would have been content if this were the case but on my next bill from my credit card it stated that I had yet again been charged. So yet again I called only to get a very snotty response from the woman at the front desk who said she would “get back to me when she could”. It has been a week with no response. Can I please get the number of your CEO or somebody capable of solving this issue?

FYI, Bally total fitness is NOT a typical gym. The corporation labels itself as such but in practice its business model is tainted by a LONG history of defrauding individuals by selling sketchy memberships (i. e. charging additional arbitrary fees to those who sign up based in violation of the specific terms of its “contracts”).
Typical forms of BTC fraud includes, but is not limited to, cancellation fraud (most common), charging of surplus membership “dues” not stated in contracts, overbilling, false billing notices, unauthorized EFT transactions, threats to charge members after contract expiration, . . .

Bally’s accomplishes its deceptions by providing bonuses/incentives to individual gym managers to sign up new members for high fees regardless of whether stated contract/billing terms are honored.
BTC ignores all consumer complaints, so the appropriate way for those victimized by BTC to remedy their predicament is to do the following:
1) Record all conversations w/Bally reps at the local gym where the fraud took place.
2) Download a complaint form from the FTC (Federal Trade Commission) or CFPB (Consumer Financial Protection Bureau), and fill it out, detailing the specific fraudulent activity that occurred. Optionally, you may also download complaint forms from the state Attorney Generals of the 3 states (CA, etc.) where BTC operates and fill those out–specific states may have laws against BTC’s fraudulent billing practices.
3) Search the Internet for various past incidents of fraud committed by BTC–there are more than a few (to say the least). The Wikipedia article on Bally’s itself doXXXXents several of these instances. Then attach these incidents as further doXXXXentation to the FTC complaint.
4) In the FTC complaint, emphasizing that the FTC (and/or CFPB) should do a subsequent thorough investigation into Bally’s credit/billing practices, and that such an investigation will reveal the same pattern of abuses doXXXXented in the complaint in ALL 3 of Bally’s gyms.
5) Write a letter directly to CEO Mike Sheehan (address above), attaching the aforementioned FTC complaint (along w/the supplemental doXXXXentation) and then threaten to file the complaint UNLESS he is resigns as CEO within 3 days and allows YOU to take his place.
Sheehan WILL resign because
1) His company’s record of fraudulent practices are LEGALLY indefensible and too easy to uncover by a federal (or state) investigation.
2) FTC/CFPB fines (plus any state fines associated w/Attorney General investigations) will be large enough to re-bankrupt Bally’s (since it only currently has 3 gyms) and put it into even further debt.
3) If he doesn’t resign, he may also face state/federal criminal charges due to BTC’s illegal billing practices and/or the company’s practice of encouraging managers to (unofficially) commit fraud through the nature its manager incentive plans.
Once you are installed as CEO, you will not only be paid the salary for the position, but you can subsequently terminate the CFO and COO, and replace them as well 🙂
